Special legislation

In France, certain species are protected by special legislation regulating their fishing. This legislation may limit the periods or the fishing methods. There are also special bans for the coasts of Corsica.

THE TUNA THUNNUS THYNNUS
Recreational and sport fishing of the bluefin tuna is prohibited in the eastern Atlantic and in the Mediterranean from 15 October to 15 June.

For recreational fishing (non-commercial fishing practised by people who are not members of a national sport organization and do not hold a national sport licence) :

1. each member state delivers authorisations for fishing from boats for recreational fishing purposes ;
2. in the case of recreational fishing, it is prohibited to catch, keep on board, transfer or unload more than one bluefin tuna per sea trip ;
3. the marketing of bluefin tuna caught in the course of recreational fishing is prohibited, except for charitable purposes ;
4. each member state records the catch data for recreational fishing and communicates the data from the previous year to the Commission not later than 30 June each year. The Commission passes on this information to the permanent committee for research and statistics of the International Commission for the Conservation of the Atlantic Tuna (ICCAT) ;
5. each member state undertakes the measures necessary to ensure, as far as possible, the release of bluefin tuna captured alive, in particular juveniles, during recreational fishing.

For sport fishing (non-commercial fishing practised by members of a national sport organization or holders of a national sport licence) :
1. each member state regulates sport fishing, in particular by issuing authorisations for fishing from boats for recreational fishing purposes ;
2. the marketing of bluefin tuna caught during sport fishing competitions is prohibited, except for charitable purposes ;
3. each member state records the catch data for sport fishing and passes on the data for the previous year to the Commission by 30 June of each year at the latest. The Commission passes on this information to the International Commission for the Conservation of the Atlantic Tuna (ICCAT) ;
4. each member state undertakes the measures necessary to ensure, as far as possible, the release of bluefin tuna caught alive, in particular juveniles, during sport fishing Decree of 11 June 2009 : Decree of 11-06-2009 | Regulation (EC) n° 302/2009 of the Council of 6 April 2009 : Regulation-EC-302-2009

THE DUSKY GROUPER EPINEPHELUS MARGINATUS AND OTHER GROUPER
In France, underwater fishing of the grouper has been prohibited since 1983 along the coasts of Corsica and since 1993 along the coasts of the French mainland. These are moratoria of limited duration which need to be renewed every five years. From 2003, the ban also includes line fishing along the coasts of the French mainland.

On 23 December 2013, this ban was renewed for 10 years and applies to five species of grouper.
-  Underwater fishing prohibited for the five grouper species (Epinephelus marginatus, E. costae, E. caninus, Mycteroperca rubra and Polyprion americanus) in the regions of Provence-Alpes-Côte d’Azur, Languedoc-Roussillon and Corsica ; duration 10 years.
-  Recreational line fishing prohibited for four grouper species (Epinephelus marginatus, E. costae, E. caninus, Mycteroperca rubra) in the regions of Provence-Alpes-Côte d’Azur, Languedoc-Roussillon and Corsica ; duration 10 years.
- Professional line fishing prohibited for four grouper species (Epinephelus marginatus, E. costae, E. caninus, Mycteroperca rubra) in the regions of Provence-Alpes-Côte d’Azur, Languedoc-Roussillon and Corsica ; duration 10 years.

The MEAGRE SCIAENA UMBRA
A new fish species has been added to the grouper, the meagre (Sciaena umbra), for which underwater and recreational line fishing are prohibited in the Provence-Alpes-Côte d’Azur, Corsica, and Languedoc-Roussillon regions ; duration 5 years.

THE EDIBLE SEA URCHIN PARACENTROTUS LIVIDUS
The legislation concerns the fishing periods and quotas authorised.
Fishing authorized between 1 November and 15 April on the mainland Mediterranean coasts.

Fishing quotas :
-  underwater or shoreline fishing by hand : 4 dozen per fisher per day ;
-  fishing from a pleasure boat : 4 dozen per fisher per day with a maximum of 10 dozen for more than 2 people on board.

The minimum size for fishing is 5 cm (excluding spines) at sea, and 3.5 cm in lagoons.

The fishing of sea urchins along the whole of the coastline of Corsica, whatever the fishing method used, is only authorized from 15 December to 15 April. Recreational fishers may not catch and transport more than 3 dozen sea urchins per person.

SPECIAL PROHIBITIONS FOR THE COASTS OF CORSICA
For several years, Corsica has been subject to special legislation for underwater fishing involving the prohibition of fishing for certain species. The latest decree (decree of the Corsican regional maritime affairs authority of 13 December 2004) banned underwater fishing of the following species in all the territorial waters around the coasts of Corsica up until 31 December 2012 : Moratorium for the grouper on the Corsican coasts : Decree-DRAM-13-12-2004 | Prolongation of the decree for the Corsican coasts : Decree n°2012352-003 of 17 December 2012
